Terms of Use

These terms of use describe your rights and responsibilities when using the Teacher Campus website. Please read them carefully. By using the Teacher Campus website, you accept these terms of use, and you agree to the collection and use of information as described in the Privacy Policy section of this document.

Teacher Campus is owned and operated by Southwestern Ohio Instructional Technology Services (SOITA), a 501(c)3 nonprofit organization in Dayton, Ohio. We reserve the right to update or modify the Terms of Use for TeacherCampus.org without advance notice by posting a revised Terms of Use to the Website. We encourage you to review the Terms of Use periodically. The Teacher Campus may also, in the future, offer new services and/or features through the Website, including the release of new tools and resources. Such new features and/or services shall be subject to the terms and conditions of this Agreement.


By using TeacherCampus.org, you agree to be bound by the version of the Terms of Use then in effect. If at any point you no longer agree to the Terms of Use, please discontinue your use of TeacherCampus.org. Teacher Campus may deny service to you at any time, including in the event you do not adhere to the Terms of Use.


Payment Terms

In many instances, Employers will pay for the access rights of each Member to this Site. To the extent that your Employer does not pay for your access rights, you agree to pay for all services and products that you order from TeacherCampus.org. For all billed Services of monthly subscriptions, your subscription will automatically renew monthly on or about your expiration date unless you cancel your Service prior to the beginning of the next applicable billing (and renewal) period. For all billed Services of annual subscriptions, your subscription will automatically renew annually on or about your expiration date each year at a discounted, full-year price, unless you cancel your Service prior to the beginning of the next applicable billing (and renewal) period. The primary credit or debit card you have stored in the credit card processing website that you select in your original purchase will be charged on or about your expiration date of each subsequent year as set forth above.

Refund Policy

We offer a 14 day guarantee on all of our annual memberships.  If you are not satisfied with your purchase, you may receive a full refund of purchase price within 14 days of purchase as long as no certificates of completion have been issued.

Ownership of Content

All materials presented on or accessed through the website, including but not limited to website content, course descriptions, course content, downloadable resources, and images, are the property of Teacher Campus or are used by Teacher Campus with permission from the copyright holder. Accessing this website or purchasing products or services from Teacher Campus does not provide or imply any ownership of these materials. Customers may save or reproduce materials and resources presented in Teacher Campus courses or on this website for their own use, but may not provide them to other parties or incorporate them, in whole or in part, into other trainings or materials, except where permission is expressly granted by Teacher Campus in writing.


User Postings

Teacher Campus may now or in the future permit the posting by You and other Users of comments, written works, images, audio works, audio-visual works or other communications (collectively, “User Postings”) and the hosting, sharing, and/or publishing of such User Postings. You understand that whether or not such User Postings are published, Teacher Campus does not guarantee any confidentiality with respect to any submissions.

By submitting content to Teacher Campus for inclusion on TeacherCampus.org, you grant Teacher Campus a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content in whole or in part, in any media formats and through any media channels (now known or hereafter developed). You also irrevocably grant the Website’s users the right to access your postings in connection with their use of the Site. If you delete content, Teacher Campus will use reasonable efforts to remove it from TeacherCampus.org, but you acknowledge that caching or references to the content may not be made immediately unavailable.

You are solely responsible for Your User Postings and the consequences of posting or publishing them. By uploading and publishing Your User Postings, You affirm, represent, and warrant that:

(1) You are the creator and owner of or have the necessary licenses, rights, consents, and permissions to use and to authorize Teacher Campus and Teacher Campus’s Users to use and distribute Your User Postings as necessary to exercise the licenses granted by You in this Section and in the manner contemplated by Teacher Campus and these Terms of Use;

(2) Your User Postings do not and will not:

(a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right or

(b) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person;

(3) Your User Postings do not contain any viruses, adware, spyware, worms, or other malicious code. Violators of third-party rights may be subject to criminal and civil liability. Teacher Campus reserves all rights and remedies against any User who violates these Terms.

(4) Your User Postings are relevant to the educational community and contain no advertisements.

You understand that when using the Site You will be exposed to User Postings from a variety of sources, and that Teacher Campus is not responsible for the content of such User Postings (including, without limitation, the accuracy, usefulness, or intellectual property rights of or relating to such User Postings). You further understand and acknowledge that You may be exposed to User Postings that are inaccurate, offensive, indecent or objectionable, and You agree to waive, and hereby do waive, any legal or equitable rights or remedies You have or may have against Teacher Campus with respect thereto.


Teacher Campus does not endorse or adopt any User Postings or any opinion, recommendation or advice expressed therein, and Teacher Campus expressly disclaims any and all liability in connection with User Postings. If notified by a User or a content owner of a User Posting that allegedly does not conform to these Terms of Use, Teacher Campus may investigate the allegation and determine in its sole discretion whether to remove the User Posting, which it reserves the right to do at any time and without notice.

The copyright of the materials on the Website is owned by Teacher Campus and/or the copyright owners who have given Teacher Campus permission to use their materials on this website.

You acknowledge and agree that the information and materials presented on or through TeacherCampus.org will remain the property of Teacher Campus and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations. The materials produced by or for Teacher Campus (including photographs, graphics, video and audio content) are protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries. All individual articles, content, and other elements, including photographs, comprising this compilation and produced by or for Teacher Campus are also copyrighted works. You agree to abide by all additional copyright notices or restrictions contained in any materials produced by or for Teacher Campus.


Trademarks

The trademarks, service marks, logos and trade names displayed on TeacherCampus.org (collectively the “Marks”) are the registered and unregistered trademarks of Teacher Campus, Teacher Campus’s licensors and suppliers, and others. All Marks on TeacherCampus.org not owned by Teacher Campus are the property of their respective owners. The Marks owned by Teacher Campus, whether registered or unregistered, may not be used in connection with any product or service that is not Teacher Campus’s.


Eligibility

Children under the age of 13 may not create an account at TeacherCampus.org.


Professional Development Certificates

Certificates issued by Teacher Campus are official only if they are printed directly from the website, signed by the customer named on the certificate, and unaltered. Certificates are issued in the language the customer selects while ordering the course. Teacher Campus certificates may not be reproduced, shared, or transferred. In the event of any dispute over certificate authenticity, the determination of Teacher Campus is final. Teacher Campus reserves the right to verify certificates for third parties, including but not limited to professional associations, state licensing bodies, and corporations, but will not provide or discuss any customer data beyond what is necessary to establish the authenticity of a certificate.

Independent Resellers and Hosted Courses

Teacher Campus may host courses on behalf of other entities. If a Teacher Campus customer accesses a training through the website but the payment was not processed by Teacher Campus, Teacher Campus accepts no responsibility for refunds or exchanges. Any such request must be directed to the entity (such as an independent reseller) by whom the payment was processed.


Termination

You agree that Teacher Campus, in its sole discretion, for any or no reason, and without penalty, may terminate any account (or any part thereof) You may have with Teacher Campus or Your use of the Site and remove and discard all or any part of Your account, User profile, and any User Posting, at any time. Teacher Campus may also in its sole discretion and at any time discontinue providing access to the Site, or any part thereof, with or without notice. You agree that any termination of Your access to the Site or any account You may have or portion thereof may be effected without prior notice, and You agree that Teacher Campus will not be liable to You or any third party for any such termination.


Third-Party Sites, Services, and Links

TeacherCampus.org provides links to other websites and resources. Because Teacher Campus has no control over these sites and resources, you acknowledge and agree that Teacher Campus does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Teacher Campus is providing these links to you only as a convenience.


Other websites may link or refer you to this website. Teacher Campus is not responsible for the content of those websites. Such referrals or links are not a warranty by Teacher Campus of the information and materials on the referring or linking websites. Neither are they an endorsement by Teacher Campus of the organizations or individuals operating those websites.


Disclaimer of Warranties

The Website is provided “as is.” Teacher Campus and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Teacher Campus nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.


Limitation of Liability

In no event will Teacher Campus, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that increase the fees paid by you to Teacher Campus under this agreement during the twelve (12) month period prior to the date the cause of the action accrues. Teacher Campus shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.


General Representation and Warranty

You represent and warrant that (i) your use of the Website will be in strict accordance with the Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

Jurisdictional Issues


TeacherCampus.org is controlled and operated by Teacher Campus from its principal office in Dayton, OH, U.S.A., and is not intended to subject Teacher Campus to the laws or jurisdiction of any other state, country or territory. Those who choose to access TeacherCampus.org do so on their own initiative and at their own risk, and are solely responsible for complying with all local laws, rules, and regulations.


Users accessing this site from outside of the United States, including the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please note that your personal data is being transferred to the United States, and by providing your personal data you consent to the transfer of your personal data to the United States and to its use for the purposes identified in accordance with our Privacy Policy.


Indemnification

You agree to indemnify and hold harmless Teacher Campus, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to out of your violation this Agreement.


Miscellaneous

This Agreement constitutes the entire agreement between Teacher Campus and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Teacher Campus, or by the posting by Teacher Campus of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the Commonwealth of Ohio, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state courts of Ohio and federal courts located in Montgomery County, Ohio.
